Article 26

Obligations of deployers of high-risk AI systems

Applies from December 2, 2027Official source (EUR-Lex)

What does Article 26 of the AI Act require?

Article 26 sets the duties of deployers, the organisations that use a high-risk AI system under their own authority, such as an employer running an AI recruiting tool. They must use the system according to the provider's instructions, assign human oversight to people with the competence, training and authority to exercise it, and keep input data they control relevant and sufficiently representative. They must monitor operation, inform the provider and the authority and suspend use if the system presents a risk, and report serious incidents. Logs under their control must be kept for at least six months. Employers must inform workers and their representatives before using such a system at work, and deployers of Annex III systems that make or support decisions about people must tell those people. After the Digital Omnibus, these duties apply from 2 December 2027 for Annex III systems and from 2 August 2028 for Annex I systems. Breaches can be fined up to EUR 15 million or 3 % of worldwide annual turnover.
