Article 6

Classification rules for high-risk AI systems

Applies from December 2, 2027Official source (EUR-Lex)

What does Article 6 of the AI Act require?

Article 6 decides whether an AI system is high-risk. It matters to providers, who carry most high-risk duties, and to deployers, whose Article 26 duties follow from it. There are two routes. Under Article 6(1), a system is high-risk if it is a safety component of a product, or itself a product, covered by the EU legislation in Annex I, such as machinery or medical devices, and needs a third-party conformity assessment. Under Article 6(2), systems used in the Annex III areas are high-risk, for example biometrics, education, employment and access to essential services such as credit. Article 6(3) lets an Annex III system fall outside when it poses no significant risk, for instance because it only performs a narrow procedural or preparatory task, but never when it profiles people. A provider relying on this must document that assessment before placing the system on the market. Since the Digital Omnibus, the high-risk requirements apply from 2 December 2027 (Annex III) and 2 August 2028 (Annex I).
