What does Article 5 of the AI Act require?

Article 5 bans certain AI practices outright. It binds anyone who places such a system on the EU market, puts it into service or uses it, so providers and deployers alike, and it has applied since 2 February 2025. Banned are: manipulative or deceptive techniques and the exploitation of vulnerabilities such as age or disability, where they cause significant harm; social scoring that leads to detrimental treatment in unrelated contexts or out of proportion; predicting crime from profiling or personality traits alone; untargeted scraping of facial images for recognition databases; emotion recognition at work and in education, except for medical or safety reasons; biometric categorisation to infer traits such as race or sexual orientation; and real-time remote biometric identification in public spaces for law enforcement, outside narrow exceptions. The Digital Omnibus adds points (ba) and (bb), on AI that generates non-consensual intimate imagery and child sexual abuse material, from 2 December 2026. Fines reach EUR 35 million or 7 % of worldwide annual turnover.
