What does Article 99 of the AI Act require?

Article 99 sets the penalty framework and has applied since 2 August 2025. It obliges Member States to lay down effective, proportionate and dissuasive penalties that take the interests of SMEs into account, and it fixes three ceilings for fines. Using a practice prohibited by Article 5: up to EUR 35 million or 7 % of total worldwide annual turnover. Breaching the obligations of providers, authorised representatives, importers, distributors, deployers or notified bodies, or the transparency duties in Article 50: up to EUR 15 million or 3 %. Giving incorrect, incomplete or misleading information to authorities or notified bodies: up to EUR 7.5 million or 1 %. For undertakings the higher figure is the ceiling; for SMEs and start-ups the lower one applies, and the Digital Omnibus added Article 99(6a), which gives small mid-caps the same lower-of cap for the fines in Article 99(4) and (5). Authorities weigh factors such as gravity, duration, intent, cooperation and company size. Fines on providers of general-purpose AI models are a matter for the Commission under Article 101.
